By accessing or using Tamato ("the Service", "we", "us", "our") at tamato.design or any associated subdomain, API endpoint, or application, you ("User", "you", "your") agree to be legally bound by these Terms of Service ("Terms"). If you do not agree to these Terms in their entirety, you must immediately cease all use of the Service.
These Terms constitute a legally binding agreement between you and Tamato. Your continued use of the Service following any modification to these Terms constitutes your acceptance of the modified Terms.
You must be at least thirteen (13) years of age to use the Service. Users under the age of thirteen (13) are strictly prohibited from accessing or using the Service in any capacity.
If you are between the ages of thirteen (13) and seventeen (17) inclusive, you may only use the Service with the express prior consent of a parent or legal guardian. By using the Service as a minor, you represent that:
For users under eighteen (18) years of age, a parent or legal guardian must provide a valid email address separate from the minor's email address. A confirmation link will be sent to that address which must be clicked to activate the account. The timestamp of that confirmation is stored permanently and constitutes documented parental consent under the Children's Online Privacy Protection Act (COPPA) and applicable Kentucky law.
Any misrepresentation of age during registration is a material breach of these Terms and will result in immediate account termination without refund. Tamato reserves the right to pursue all available legal remedies in the event of such misrepresentation.
By using the Service, you represent and warrant that you have the full legal capacity to enter into a binding contract under applicable law, or that a parent or guardian has done so on your behalf as described above.
Tamato offers a free trial tier that requires only an email address. No formal account creation, subscription, or payment information is required to access the free trial.
The free trial is subject to the usage limitations described in our current pricing documentation, which is incorporated by reference into these Terms. Trial limitations include but are not limited to restricted generation counts, edit counts, and model access.
Free trial data is session-based and non-persistent. Tamato makes no guarantee of data retention for free trial users. All trial data may be reset or permanently deleted at any time without notice.
The free trial is provided strictly on an "as-is" basis with no warranty of any kind, express or implied.
Tamato offers the following paid tiers, the features and pricing of which are described on our pricing page and incorporated by reference:
All payments are processed through Stripe, Inc. By providing payment information, you authorize Tamato to charge your payment method for all applicable fees. You represent that you are authorized to use the payment method provided.
Monthly and annual subscriptions automatically renew at the end of each billing period unless cancelled prior to the renewal date. You are responsible for cancelling your subscription before renewal if you do not wish to be charged.
Annual subscriptions are offered at a 5% discount on the equivalent monthly rate and are billed as a single upfront payment covering twelve (12) months of service.
Tamato reserves the right to modify pricing at any time. Existing subscribers will receive no less than thirty (30) days written notice via email before any price increase takes effect on their account.
Single Site purchases are eligible for a full refund only if requested before the user has downloaded the exported site files (zip archive). Once the export function has been used and files have been downloaded, the sale is final and no refund will be issued under any circumstances.
Upon processing a refund for a Single Site purchase:
Monthly subscription payments are non-refundable. If you cancel a monthly subscription mid-cycle, your access continues until the end of the current billing period, after which your account is downgraded. No partial refunds are issued for unused days.
Annual subscription payments are non-refundable after fourteen (14) days from the initial purchase date. Within the first fourteen (14) days, a prorated refund may be issued at Tamato's sole discretion.
You agree to contact Tamato directly at support@tamato.design to resolve any billing disputes before initiating a chargeback with your payment provider. Initiating a chargeback without first contacting Tamato is a material breach of these Terms and may result in permanent account termination.
You may cancel your subscription at any time through your account settings or by contacting support. Cancellation takes effect at the end of the current billing period.
Upon cancellation of any paid subscription:
After five (5) calendar days following subscription termination, all of your sites, generated HTML files, prompts, and associated user data stored on Tamato's servers are permanently and irrecoverably deleted. Tamato has no obligation to recover deleted data under any circumstances. You are solely responsible for exporting and preserving any data you wish to retain before your account is terminated.
Tamato does not offer tier downgrading. Your only options are to maintain your current tier, upgrade to a higher tier, or cancel. Upon cancellation and resubscription, you may subscribe to any available tier.
If you resubscribe after data deletion has occurred under Section 6.3, your account will begin fresh with no previously generated sites or data. Tamato is not liable for any loss resulting from data deletion following cancellation.
Any site files exported (downloaded as a zip archive) prior to cancellation remain your property permanently regardless of your subscription status. Tamato claims no ownership over exported files.
Upon generation of a website using the Service, and subject to these Terms, you own the HTML, CSS, and JavaScript output generated for your account. This ownership is unconditional and does not depend on maintaining an active subscription.
By using the Service, you grant Tamato a limited, non-exclusive, royalty-free license to store, process, and display your generated content solely for the purpose of providing the Service to you. This license terminates upon data deletion under Section 6.3 or account termination.
The Tamato platform, including its interface, branding, design system, prompt engineering, infrastructure, and underlying technology, is the exclusive intellectual property of Tamato. You may not copy, reverse engineer, decompile, or create derivative works based on the Tamato platform itself.
Tamato uses third-party AI models to generate website content. You acknowledge that AI-generated content may not be eligible for copyright protection under current United States law, and that Tamato makes no representation regarding the copyrightability of generated outputs.
Tamato does not guarantee that AI-generated content is free from intellectual property claims by third parties. You assume full responsibility for reviewing generated content before publication and for any intellectual property claims arising from your use of generated content.
You agree that you will not use the Service to create, distribute, host, or facilitate any of the following:
Any content that violates applicable federal, state, local, or international law or regulation, including but not limited to content that constitutes fraud, defamation, harassment, or violation of export control laws.
Any website designed to deceive, defraud, mislead, or manipulate users, including phishing sites, scam sites, fake storefronts, impersonation sites, or any site designed to obtain personal or financial information through deception.
Any website containing sexually explicit material, adult content, pornography, or any content that sexualizes individuals in any manner. This prohibition applies regardless of whether such content would be legal in your jurisdiction.
Any website that promotes, facilitates, or instructs in violence, self-harm, terrorism, extremism, human trafficking, illegal weapons, controlled substances, or any activity that endangers the health or safety of any individual.
Any website containing malware, ransomware, spyware, viruses, trojans, or any code designed to harm, surveil, or gain unauthorized access to users' devices or data.
Any website used to facilitate mass unsolicited communications, spam campaigns, or any form of communication that violates the CAN-SPAM Act or similar laws.
Any website that infringes upon the intellectual property rights of any third party, including unauthorized use of trademarks, copyrighted materials, or trade secrets.
Any website that promotes discrimination, hatred, or violence against any individual or group based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, or any other protected characteristic.
Tamato reserves the right, but has no obligation, to monitor sites created using the Service. Upon discovering or receiving credible reports of violations of this Acceptable Use Policy, Tamato may:

TAMATO SPECIFICALLY DISCLAIMS ANY AND ALL WARRANTIES, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY OF DATA, OR NON-INFRINGEMENT. TAMATO DOES NOT REPRESENT OR WARRANT THAT THE SERVICE (OR ANY PART, FEATURE, OR CONTENT THEREOF) IS COMPLETE, ACCURATE, OF ANY CERTAIN QUALITY, RELIABLE, OR SECURE IN ANY WAY, OR SUITABLE FOR OR COMPATIBLE WITH ANY OF YOUR INTENDED USES OR OPERATIONS. THERE IS NO WARRANTY THAT THE SERVICE WILL BE ERROR-FREE OR THAT IT WILL OPERATE WITHOUT INTERRUPTION. TAMATO UNDERTAKES OR ACCEPTS NO LIABILITY WHATSOEVER FOR ERRORS, OMISSIONS, DELAYS, INTERRUPTIONS, OR LOSSES UNLESS CAUSED BY TAMATO'S WILLFUL MISCONDUCT.

DATA ENTRY, COMMUNICATION, AND STORAGE ARE SUBJECT TO THE POSSIBILITY OF HUMAN AND MACHINE ERRORS, OMISSIONS, DELAYS, AND LOSSES, INCLUDING INADVERTENT LOSS OF DATA OR DAMAGE TO MEDIA. TAMATO SHALL NOT BE LIABLE FOR ANY SUCH ERRORS, OMISSIONS, DELAYS, OR LOSSES.
TAMATO MAY, AT ANY TIME AND AT ITS SOLE DISCRETION, SUSPEND, DISABLE ACCESS TO, OR REMOVE YOUR ACCOUNT AND/OR ANY CONTENT OR SITES ASSOCIATED WITH YOUR ACCOUNT, WITHOUT ANY LIABILITY TO YOU OR TO ANY THIRD PARTIES.
TO THE FULLEST EXTENT PERMITTED BY LAW IN EACH APPLICABLE JURISDICTION, TAMATO'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE, WHETHER IN CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, SHALL NOT EXCEED IN THE AGGREGATE THE AMOUNTS ACTUALLY PAID BY YOU TO TAMATO DURING THE NINE (9) MONTH PERIOD PRECEDING THE OCCURRENCE OF THE ALLEGED DAMAGES, OR ONE HUNDRED UNITED STATES DOLLARS ($100.00 USD), WHICHEVER IS GREATER. THIS LIMITATION APPLIES TO ALL CAUSES OF ACTION IN THE AGGREGATE, INCLUDING BREACH OF CONTRACT, BREACH OF WARRANTY, NEGLIGENCE, STRICT LIABILITY, MISREPRESENTATIONS, AND OTHER TORTS.
TAMATO IS AN INTERACTIVE COMPUTER SERVICE AS DEFINED UNDER SECTION 230 OF THE COMMUNICATIONS DECENCY ACT, 47 U.S.C. § 230. TAMATO IS NOT THE PUBLISHER OR SPEAKER OF ANY INFORMATION PROVIDED BY USERS OF THE SERVICE. TO THE FULLEST EXTENT PERMITTED BY LAW, TAMATO IS IMMUNE FROM LIABILITY FOR ANY CONTENT CREATED, GENERATED, OR PUBLISHED BY USERS THROUGH THE SERVICE, INCLUDING BUT NOT LIMITED TO CONTENT THAT IS DEFAMATORY, OBSCENE, FRAUDULENT, DECEPTIVE, OR OTHERWISE OBJECTIONABLE OR UNLAWFUL. NO CAUSE OF ACTION MAY BE BROUGHT AGAINST TAMATO THAT TREATS TAMATO AS THE PUBLISHER OR SPEAKER OF SUCH CONTENT.
TO THE FULLEST EXTENT PERMITTED BY LAW IN EACH APPLICABLE JURISDICTION, TAMATO IS NOT RESPONSIBLE OR LIABLE FOR ANY CONTENT, WEBSITES, OR MATERIALS CREATED, GENERATED, EXPORTED, HOSTED, OR DISTRIBUTED BY USERS USING THE SERVICE. TAMATO EXPRESSLY DISCLAIMS ALL LIABILITY, WHETHER IN CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, FOR:
You acknowledge and agree that Tamato has no obligation to monitor content created using the Service and that Tamato acts solely as a technology platform providing tools for website creation.
YOU AGREE TO FULLY DEFEND, INDEMNIFY, AND HOLD HARMLESS TAMATO AND ITS OWNERS, OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, SUBCONTRACTORS, AGENTS, AND LICENSORS, UPON TAMATO'S FIRST REQUEST, FROM AND AGAINST ANY AND ALL CLAIMS, DEMANDS, CAUSES OF ACTION, DEBTS, LIABILITIES, DAMAGES, LOSSES, OBLIGATIONS, COSTS, AND EXPENSES (INCLUDING REASONABLE ATTORNEYS' FEES AND COURT COSTS) ARISING FROM OR RELATED TO:
This indemnification obligation is independent of and in addition to any other remedies available to Tamato and survives termination of these Terms and your use of the Service indefinitely.
You expressly acknowledge and agree that the disclaimers, limitations of liability, and indemnification obligations set forth in this section are fundamental elements of the basis of the bargain between you and Tamato. Tamato would not be able to provide the Service on an economically feasible basis without these limitations. These provisions shall apply to the fullest extent permitted by law in each applicable jurisdiction, and if any portion is found unenforceable, the remaining provisions shall continue in full force and effect.
The Service uses third-party AI models including but not limited to models provided by Groq, Anthropic, and other providers. Your use of the Service is subject to those providers' terms of service in addition to these Terms.
Payment processing is handled by Stripe, Inc. By using the Service, you agree to Stripe's Terms of Service and Privacy Policy. Tamato does not store your payment card information.
The Service relies on infrastructure provided by Supabase, Cloudflare, and Vercel. Tamato is not liable for service interruptions or data loss caused by failures of these third-party providers.
Tamato's inclusion of links to third-party services does not constitute an endorsement of those services.
The Melio program provides eligible applicants with extended free access to the Service under specific limitations as described in the program terms at tamato.design/melio.
Acceptance into the Melio program is at Tamato's sole and absolute discretion. Submission of an application does not guarantee acceptance. Tamato has no obligation to accept any application or provide any reason for rejection.
Tamato reserves the right to modify, suspend, or terminate the Melio program at any time without notice. Participants who have been approved and are actively using the program will receive thirty (30) days notice before termination of their access.
Any misrepresentation in a Melio application, including misrepresentation of business status, financial situation, or intent, constitutes fraud and a material breach of these Terms. Tamato reserves the right to pursue all available legal remedies.
Use of the Tamato Megisto API is subject to these Terms in addition to the API-specific documentation at tamato.design/api.
You are solely responsible for maintaining the security and confidentiality of your API key (format: tm-meg-xxxxxxxxxx). You must not share, publish, or expose your API key in any public repository, forum, or communication. Any use of the Service through your API key is your sole responsibility regardless of whether such use was authorized by you.
If you believe your API key has been compromised, you must notify Tamato immediately at support@tamato.design and request key revocation. Tamato is not liable for unauthorized use of your API key prior to notification.
API usage is billed on a pay-per-token basis as described in current API pricing documentation. You are responsible for all charges incurred through your API key regardless of whether such use was authorized.
Tamato offers an optional connector feature that allows you to connect third-party services to your Tamato account and integrate them into your generated websites. Available connectors include but are not limited to: Google (Maps, Sheets, YouTube), Stripe, Calendly, PayPal, Mailchimp, Notion, Instagram, OpenTable, and Spotify (collectively "Connectors").
CONNECTORS ARE PROVIDED STRICTLY ON AN "AS IS" AND "USE AT YOUR OWN RISK" BASIS. BY CONNECTING ANY THIRD-PARTY SERVICE TO YOUR TAMATO ACCOUNT, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:

Tamato is not a party to any agreement between you and any third-party service. Tamato has no control over and accepts no responsibility for the terms, policies, practices, or actions of any third-party service.
BY CONNECTING ANY THIRD-PARTY SERVICE TO YOUR TAMATO ACCOUNT, YOU EXPRESSLY ACKNOWLEDGE, CONSENT TO, AND ACCEPT FULL RESPONSIBILITY FOR THE FOLLOWING:
When you connect a third-party service, Tamato stores your OAuth tokens and credentials encrypted in our database solely for the purpose of enabling the Connector functionality. You acknowledge and agree that:
This section is critically important. Read it carefully before using Connectors and exporting your site.
"Use at your own risk" is a legal term meaning that Tamato accepts zero responsibility for any negative outcome that results from your decision to export a site containing connector credentials. If something goes wrong — your accounts get hacked, money gets stolen, your data gets exposed, your connected services get misused — that is entirely your problem, not Tamato's. Tamato will not compensate you, reimburse you, assist you, or accept any legal liability. You made the choice to export. You accepted the risk. The consequences are yours alone.
When you export a website that uses active Connectors, the following occurs automatically and irrevocably:
Plain text credentials in an HTML file means that anyone who can access your file can see your credentials instantly by:
This is not a bug or a flaw in Tamato's system. This is an inherent and unavoidable consequence of the nature of client-side HTML files and how browser-based websites work. No website builder can embed live third-party service credentials in a standalone HTML file and keep those credentials secret from anyone who can view the file.
By exporting a site with active credentials you are accepting all of the following risks, without limitation:
Any person who obtains your exported HTML file can extract your API keys and OAuth tokens and use them to access your connected accounts — your Google account, your Stripe account, your Mailchimp lists, your PayPal account, your Notion workspace, your Instagram account, your Spotify account, your OpenTable account, and your Calendly account — without your knowledge or permission.
Exposed Stripe and PayPal credentials can be used to process fraudulent transactions, issue refunds, transfer funds, or otherwise manipulate your payment accounts. Tamato is not liable for any financial loss of any amount resulting from exposed payment credentials.
Exposed Google Sheets, Mailchimp, and Notion credentials can be used to access, copy, modify, or delete your data, your customers' data, your mailing lists, and any other information stored in those services.
Exposed OAuth tokens may allow third parties to take control of your connected accounts, change your credentials, lock you out, or impersonate you or your business.
Exposed Mailchimp credentials can be used to send spam emails from your account. Exposed Google credentials can be used to abuse your Google services. Exposed Spotify credentials can be used to manipulate your account. All resulting consequences — account suspension, legal liability, reputational damage — are yours alone.
A single exposed credential can lead to unauthorized access across multiple services if those services share authentication or if attackers use the initial access to gain further access to your systems.
If you host your exported site publicly, search engine crawlers may index your source code and make your credentials discoverable through public search engines. Tamato is not liable for any consequences of search engine indexing of your exported files.
By exporting a site with active Connectors and accepting the risk acknowledgment, you take on full and sole responsibility for:

THIS LIMITATION APPLIES REGARDLESS OF WHETHER TAMATO WAS ADVISED OF THE POSSIBILITY OF SUCH HARM AND REGARDLESS OF THE SEVERITY OR FORESEEABILITY OF THE HARM.
BY CLICKING "I UNDERSTAND, EXPORT" IN THE EXPORT RISK ACKNOWLEDGMENT MODAL, YOU CONFIRM THAT YOU HAVE READ AND UNDERSTOOD THIS ENTIRE SECTION, THAT YOU ACCEPT ALL RISKS DESCRIBED HEREIN WITHOUT RESERVATION, AND THAT YOU AGREE TAMATO BEARS NO LIABILITY WHATSOEVER FOR ANY CONSEQUENCES OF YOUR EXPORT. THIS ACKNOWLEDGMENT IS LOGGED AS A LEGALLY BINDING RECORD OF YOUR INFORMED CONSENT.
You may disconnect any Connector at any time through the Connectors panel. Upon disconnection, Tamato will delete your stored tokens for that service from our systems within 24 hours. Tamato is not responsible for revoking access tokens on the third-party service's end — you must do this manually through each service's account settings.
Tamato's inclusion of any third-party service as a Connector does not constitute an endorsement, recommendation, or warranty of that service. Tamato makes no representation regarding the quality, security, reliability, or suitability of any connected service.
Tamato reserves the right to add, modify, suspend, or remove any Connector at any time without notice. Tamato is not liable for any loss or inconvenience resulting from the removal or modification of any Connector.
Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in the Privacy Policy.
These Terms and any dispute arising out of or related to the Service shall be governed exclusively by the laws of the Commonwealth of Kentucky, United States of America, without regard to its conflict of law provisions. Kentucky Revised Statutes Chapter 275 governs limited liability companies formed in Kentucky, and these Terms are intended to be consistent with and enforceable under those statutes.
You irrevocably consent to the exclusive jurisdiction and venue of the state and federal courts located in the Commonwealth of Kentucky for the resolution of any disputes arising out of these Terms or the Service.
Before initiating any formal legal proceeding, you agree to contact Tamato at support@tamato.design and attempt to resolve the dispute informally for a period of thirty (30) days.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU WAIVE YOUR RIGHT TO PARTICIPATE IN ANY CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST TAMATO.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND TAMATO EACH WAIVE THE RIGHT TO A JURY TRIAL IN ANY DISPUTE ARISING OUT OF THESE TERMS OR THE SERVICE.
These Terms, together with the Privacy Policy and any additional terms incorporated by reference, constitute the entire agreement between you and Tamato with respect to the Service and supersede all prior agreements, representations, and understandings.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
Tamato's failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
You may not assign or transfer your rights or obligations under these Terms without Tamato's prior written consent. Tamato may assign these Terms freely without restriction.
Tamato reserves the right to modify these Terms at any time. Material changes will be communicated via email to registered users no less than fourteen (14) days before taking effect. Continued use of the Service after the effective date of modified Terms constitutes acceptance.
